General Terms and Conditions – The Paw Clicked Twice

These General Terms and Conditions apply to all offers, agreements, products, and services provided by the sole proprietorship The Paw Clicked Twice (hereinafter referred to as “the Photographer”).

By booking a photo session or purchasing a service, the Client confirms that they have read, understood, and agreed to these General Terms and Conditions.

Article 1: Definitions

• Photographer: The Paw Clicked Twice, established in the Netherlands.

• Client: Any natural person or legal entity entering into an agreement with the Photographer.

• Photo Session: Any photographic assignment, regardless of location or type of photography.

Article 2: Formation of the Agreement

• An agreement is formed following written or digital confirmation by the Client and payment of the agreed deposit.

• The Photographer carries out the assignment according to their own technical and creative judgement, consistent with the style shown on the The Paw Clicked Twice website and portfolio.

• Differences arising from the Client’s personal taste or interpretation do not constitute grounds for cancellation of the agreement or a refund.

Article 3: Prices and Payment

• All prices are communicated clearly in advance.

• When booking a photo session, a deposit is required during or following the introductory consultation.

• The remaining balance must be paid in full before delivery of the photographs, unless otherwise agreed.

• Photographs and/or products will not be delivered until full payment has been received.

Article 4: Cancellation and Rescheduling

• Cancellation or rescheduling of a photo session must be communicated in writing as soon as possible.

In the event of cancellation:

• More than 48 hours before the photo session: no additional cancellation fee will be charged.

• Less than 48 hours before the photo session: the deposit will not be refunded.

The deposit is paid during or following the introductory consultation and serves as compensation for work already carried out, including but not limited to preparation, planning, communication, and reservation of the Photographer’s time. For this reason, the deposit is non-refundable in the event of cancellation.

Rescheduling the photo session is, where possible, permitted once free of charge and is subject to the Photographer’s availability.

The Photographer aims to maintain a customer-friendly policy but reserves the right to charge additional costs in the event of repeated rescheduling or cancellation.

Article 5: Force Majeure

In the event of force majeure, such as illness, extreme weather conditions, technical failures, or other unforeseen circumstances, the Photographer cannot be held liable for any resulting damage.

In consultation with the Client, the photo session will either be rescheduled or the deposit will be refunded.

No additional compensation or damages will be payable.

Article 6: Performance and Delivery

• The Photographer independently determines the selection of photographs, unless otherwise agreed.

• Unedited photographs and/or RAW files will never be provided.

• Post-processing is an essential part of the style and working method of The Paw Clicked Twice.

• Photographs will normally be delivered within 1 to 2 weeks following the final selection and receipt of full payment, unless otherwise agreed.

• Photographs are delivered digitally. Prints and other products will be supplied where agreed.

• The Photographer may retain backup copies for a maximum period of 2 years following delivery. No rights or guarantees may be derived from this backup service.

Article 7: Copyright and Usage Rights

• All copyrights in the photographs remain with The Paw Clicked Twice at all times.

• The Client receives a non-exclusive right of use for personal, private purposes.

• Commercial use is only permitted with the Photographer’s prior written consent.

• When photographs are published online, the Photographer’s name should be credited where reasonably possible.

Article 8: Publication by the Photographer

• Photographs without identifiable individuals may be used by The Paw Clicked Twice for its website, portfolio, and social media.

• Photographs in which individuals are recognisable will only be published after obtaining their explicit written consent.

• The Client may withdraw consent for future use at any time by submitting a written request.

Article 9: Liability

• The Photographer is not liable for indirect damage, consequential loss, or loss of income or profits.

• The Photographer’s liability is limited to the amount paid or agreed for the relevant photo session.

• This limitation does not apply in cases of intent or gross negligence.

• The Client remains responsible at all times for themselves, any accompanying persons, and their animals during the photo session.

Article 10: Complaints

• Complaints must be submitted in writing within 14 days of delivery.

• After this period, the delivered work will be considered accepted by the Client.

• Submitting a complaint does not suspend the Client’s payment obligation.

Article 11: Right of Withdrawal

• Photography services may involve individually tailored or customised work.

• The statutory right of withdrawal may not apply once performance of the service has begun, where permitted by applicable law.

Article 12: Applicable Law

• All agreements are exclusively governed by Dutch law.

• Any disputes will be submitted to the competent court in the Netherlands, subject to applicable mandatory jurisdiction rules.

Article 13: Severability

If any provision of these General Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
